So my wife hit this guys car in the parking lot while trying to park her car. Nothing to speak of on our car but she tweaked the front bumper and a portion of the fender on his 98' Tacoma. She left a not since he wasnt there leaving our # so I spoke to him today and he said he already got a quote of $820.
We spoke to AAA who we have insurance with and never have made a claim. They said her premium WILL go up for the next 3 years. Insurance also said that if we pay the owner out of pocket there is a chance he will still make a claim so we would be out the cash and have our insurance go up. Whats the standard procedure on this? Im just suprised that here we have never had any claims, tickets or accidents and they will raise our rates! |

Was she on dope or just not a very skilled driver? If she was on dope ..just pay it. If she is not a very skilled driver ..fight it until you have to pawn your toaster.

Parking lots are private property.Tell him to pound sand and you take care of your own vehicle out of pocket without the insurance company.The only way you could get in trouble is if the owner of the parking lot pressed charges against you which will likely not happen.The cops cant do shit but make you exchange information. Dont ask me how i know

the guy is asking to see what might be recommended........ good idea. I'd pay off the guy, and make him sign a release...... and let it be known if he decided to play the insurance game, you'd be seeing him in the future. preferably when he's not aware...
as for soupersonic: sounds like you would prefer to screw people........ |

You could have him drop his vehicle where he wants to get it repaired, and then simply pay the bill. The idea(your insurance companies statement) that you could pay the repair and him still make a claim is insurance fraud, plain and simple. Paying him what the estimate is and having him simply sign a release could be a problem. It could later turn into a he said she said over prior damage. If you choose to pay for the repair be prepared to pay for a rental for a few days. It was never unusual for someone to come in when I had a shop and pay for a minor repair such as what you described.

I would turn it in to the insurance co and have them pay, thats what you have paid for all these years. if they want to increase your rates remind them that their are lots of ins cos that would love to have your business. also by DMV rules any damage over 500.00 must be reported. private property or not it is hit and run if you tell him to pound sand. he will win in court.

your gonna be out 500.00 if you use insurance, for another 300.00 you keep your rates from going up next year, you will spend an additional 300.00 in rate increases in no time at all. Get a release. |

my wife just hit a car in walmart .we paid the grand of damage we have 500 detuct. but we didnt want r rates to go up.pay it with a check and a copy of his estimate have him sign paid in full and he release you from any other liability,thats what i had him sign before i gave him the check.

Let the insurance take care of it and move on.
Parking lots may be on private property, but they also have right to public access meaning your liable for the actions you impose on others. Same as if the incident happened on a highway, without the note left this would be considered a hit and run parking lot or not. Also if the guy goes after you for car rental, time lost at work, travel, etc, your on the hook. If you let the insurance company handle it then they are on the hook. If you draw up a release he can still fill suit against you, so win or loose you still have court time to do. I'll say it again; pay the deductible and move on with your life, good luck.

I was hit about a month ago, dumb ass drove right on top of me. We pulled over, he said he was sorry and BLA BLA BLA. I didn't see the need to call the cops, he had insurance and gave me all his info. He just bough the truck and was given a ticket for the tint on his windows, way to dark. Any way, I took my truck to a body shop he has used in the past, very nice work by the way. He paid the entire bill out of pocket. I didn't call his insurance and make a big deal out of it, and he was happy about that.
I guess you will have to find out of the guy is a real man and work with you, or some sue happy piece of shit. But it will cost you your deductable and I'll bet your insurance will go up more than $300.00 a year. My wife screwed up and it's costing ME an extra $400.00 a year. |

Flynryan, i have to agree with letting insurance handle it. You know it's like one in a million chance if you run into somone they're actually a normal person..usually it's a creep looking to suck you dry for every last penny. I recently went through this myself, and had to suck it up and just pay a higher rate for three years. I barely touched the guy in front of me *bent my license plate* and both claimed soft tissue damage, blah blah blah.
It sucks that we pay through the azz for insurance but still pay out of pocket to make problems go away without a rate spike...what a racket!

Most insurance co's these days don't raise the rates on a first claim. if yours does i would be lookin for another! a friend has AAA and their kid hit some girl and they paid and their rates did not go up so double check with them. if they don't work check nationwide they have some very cheap rates.

I'm a little confused with the $500 deductible. Typically, if its a claim on someone elses insurance there usually isn't a deductible to the insured. If it's on your own vehicle, policy under collision there's a deductible to the insured(you the policy holder).

On an $850 claim, with $500.00 deductible, I can't see your rate escalating by very much.
HOWEVER, is you stack up another one soon, then it could be substantial. For the extra $350.00, I would pay the body shop out of pocket, just to hedge the possibility of another chargeable in the next 3 years. The whole "parking lots are private property" is an urban myth. They may very well be, but the rules still apply. There is no release of liability just because it didn't happen on a road. My advice is pay the body shop direct. All the evidence you may need for Judge Judy in the future is on the invoice copy.
