Did he have it advertised listing it in great condition? that may help but the if he has a document saying sold as is it could be tough. if you have any ad or documentation from him saying it was tested and runs great i would ask a attorney and see, you may have a case if you can prove it was misrepresented.

Compression tester and a leak down tester can be your best friend.

Everybody knows you test drive any used boat!
Unless you assume it's junk and are prepared to live with whatever happens.

If the guy knew something was focked up....shame on him.

BUT the minute you handed him the $$ it was all your responsibility IMO

Sorry you got burned, if you like the boat mark it up to a learning experience and move on.
Sold As Is means just that
No way to win in court
Maybe something (head gasket ) rusted out after he parked it for the winter.

Normally I wouldn't get involved in something like this, but I feel obliged. I know the kid you bought the boat from and his family. In fact I spent all day yesterday four wheeling with them. I was there when he got your text message.

I boat with his family too and saw the boat run fine all last summer. I know for a fact that he took someone out for a test ride the week before you bought it and there were no problems with it.

What we have here is a case of bad luck.

It's unfortunate that this happened, but as others have pointed out.

    A. It's used.

    B. It's a boat.

Take it easy on him. He's a good kid and wasn't out to screw anybody.

    Default As-is

Yea, learned all about that document after purchasing some used Seadoos from a boat dealer in Tulsa. Runs fine, runs great, just bring'em back if you have any problem. 1 motor later, which I guess wasn't too bad as I know all about Seadoo engines now. But the BBB or my attorney couldn't do anything with that as-is document. I will never buy another used car or anything from ANY dealer. I have statred buying my stuff right here, and had pretty good luck so far.
No craigslist unless I get it for next to nothing and absolutely no ebay.

Have been to small claims a few times...not a big deal and in CA its up to 7500.00. If he sold it to you as is but told you it was turn key...then you bought a turn key problem free boat as is. Give the seller a one time help fix or sue the douche bag for full repairs x3 and worst case scenario judge will find them 1/2 responsible. Thats where the x3 comes in to play. Someone thats dishonest and will not answer there phone or at least try and work something out deserves ass pounding prison or at least get them to pay for there lies.....if they or whoever wasnt out to screw anybody then this person needs to do the right thing and help the new owner with his/her HUGE BS LIE!!!!!!
Again if he stated it was turn key, no issues and sold it to you as is....you bought a good reliable boat! Dont be afraid to pursue this person in court. This seller sounds like a realtor.

Bummer man, I feel for ya! I would leak it down, YOU should have done that when you got it home anyway. How do you know it's a 468? Do you have the receipts for the pistons and machine work? I would chalk this up as a learning experience
Nver take somebody's word for anything! "I was Told" doesn't cut it. As far as court? Really? I wouldn't waste my time or money. Just fix it and be done. Your not the first person that bought a boat that wasn't sound, and you won't be the last. Hopefully it's an easy fix for ya. Good luck Atleast you have plenty of time before summer to make it right.

Before you go off accusing the seller... lets stop for one second and look at where YOU could've changed the ENTIRE outcome of your purchase.

You had the ability to water test it but CHOSE NOT TO because of "weather." An act of God is not a very good defense. It was your decision not to wait until the weather improved. Nobody had a gun to your head to purchase the boat.

You accepted the responsibility of the risk, you chose not to do any simple compression/leak down tests, etc...

Lets hypothetically say the seller was completely honest in his assessment... the above acts would still have saved you money.

Do you see how this works. Its a boat and its used... lick your wounds, fix your boat and move on. Last time I checked no warranty is implied on used vehicles... especially a jet boat for god's sake.

    Rant over

We wash our parts in gasoline,
    We drink Alcohol,
And we go racing with Nitro-Methane!

If the seller said is was turn key...good runner, no issues...ect. Sold as is with that in mind. Then the boat is problem free as per seller states. Now if he said it has problems and they are...this that and the other and the new owner bought as is with that in mind...buyer beware but thats not the case is it? I buy alot online and in person and run into these type all the time. You are safe to pursue him in court if he sold a turn key, good runner, no issue as is boat. Give him a chance to make it right.
No mob here just hate to see lies covered by more lies and so on......like realtors. If hes a so called good kid and likes that term good then he will make it right. Used, boat or whatever term you want to say doesnt make buying anything different as how its described when being sold.
