    Like has been stated, don't waste your money.
    There is nothing a lawyer will do to reduce the mandatory minimums that are SOP for first offenses.
    Even if he can, it will end up costing more with his fees.
    I learned mine with one offense. I don't plan on a second.

    Love everyones opinions. Right wrong or indifferent didn't the guy just ask for an attorney referral?

    Cheap, expensive, or none at all, the outcome will be the same.

    BigDaytona, first off, i'm glad she's ok. It could have been much worse.

    As for the ticket, usually the cite won't say the actual BAC on it....cites will normally appear like this :

    Cvc 23152(a) DUI
    CVC 23152(b) <.08 bac
    That's simply the section used for anything over or presumed to be over a .08.

    Are you trying to challenge the PC for the initial stop? If the PC for the initial stop is not good, then any evidence found afterward is tossed out (exclusionary rule). If the stop is good (ie taillight out, speeding, weaving, etc) then it may be tough unless the off totally jacked up the case in the report somewhere etc.

    For a DUI, you are not "going to court". You are going there to receive your' mandatory minimums.

    Hey, he can pay an attorney if he wants. The outcome on a DUI will be the same 99 times out of 100.
    In my experience, the prosecutor was out in the hall before court with a huge file box with the days files. He called each person that was waiting and told us before court what he would be seeking ahead of time. For every first offender, the minimums were the standard.
    If it was not, you had the opportunity to plead not guilty then lawyer up to fight it.

    There were in fact several there on first offenses that had counsel. They received the exact same as those without council.
    This scene plays out the same every day in every US city.

    Contact Felix D'Amico at D'Amico investigations. He is not an attorney but he is an expert witness in DUI. He can refer you to an attorney, then also retain his services. His specialty is finding an error in the procedure which will probably be the only way to fight this. It does work usually there is always some sort of mistake made in the procedure and this guy can and will find it. Also a good attorney is Milligan from Milligan and Beswick. Here is the links. with a BAC that high I would not show my face in court without an attorney.
