    Default SC rules on SB 1070

    Well they struck down parts of SB1070, but left some HUGE teeth in the law that will ALLOW good ol Sheriff Joe to continue doing his job!!!!!!!

    News is saying Sheriff Joe "arrested" a 6 year old illegal child on the same day as obama gave the kids a pass...... What the mainstream media ISN'T reporting is that the child was with 15 smugglers that were caught and arrested and the child had no parent/family present. The child is with Children's Services, NOT in tent city.....

    X2 Plenty good enough to get the job done. I will be sure to ask about any increase in traffic at the I-40/ca. checkpoint next time i head over your way. With Az. no longer being safe i would expect a sharp increase in population for ca. and nm. for the next few months as well as a decrease in work load for that dedicated group of boarder patrol officers who work that hell hole known as the southern az. desert.
    The decision gives a bunch of other states solid ground to write/enact and enforce their own laws.
    Mandatory enforcement of e-verify should just about seal the deal except for bo's last ditch attempt at am-nasty which was on shaky ground from the beginning.
    The most important point being that the SC intends to base decisions based on the intent of the constitution instead of some twisted left handed interptation.

    Uh, they actually took the TEETH out of it. They left the "let me see your papers" part which was a large part of it but they threw out the ability to detain possible illegals. It has no teeth. It's not enforceable without being able to arrest. So basically now if a cop pulls someone over they can ask to see papers but if they can't provide those papers, they can't do shit about it but let them go.

    Cop: Let me see your driver's license.
    Suspect: I don't have it with me.
    Cop: Are you a citizen of this country?
    Suspect: No.
    Cop: Let me see your visa or immigration papers.
    Suspect: I don't have it with me.
    Cop: Well shit, here's a ticket for driving without a license. Have a nice day.

    The bottom line is that that illegals will be far less comfortable taking up Arizona space than elsewhere and every state now knows which provisions they can pass in their own legislation with the blessing of the supreme court. This will have a greater impact than most think.

    Actually that's not true Boss. Even before this bill was passed the local Law Enforcement could turn over illeagals to ICE when they knew they had illeagals. So they can still turn them over and they can go further in identifying illeagals. they just can't arrest for what the bill considered other laws that were deportable offenses. Being illeagal is still arrestable and deportable.
    If you voted for Obama to prove you were not racist, then you better find someone else to vote for to prove your not stupid.

    Get pulled over in az without a valid d/l you will lose your car and might get locked up. Even a ticket might cost 500. If anything i would expect the sale of used bicycles to skyrocket. Az far as no id, it's up to the officers discretion, write a ticket or lock you up until who you are can be verified.
    If anything az. has created an environment that lacks hospitality for those who are not here legally and self deportation will cost the state much less than a lap through the legal system.

    not so quick, didn't I read somewhere that illegals are being handled much diffrently. Not subject to vechicle impound, not arrested but given a pass because of being a minority and illegal?

    This is probably the best thing that came out of it. At least it makes them nervous but that's about all that I can see.

    But they would have to know they had illegals first and they can't detain with only suspicion.

    This is my point. This right here was one of the 3 provisions they threw out. They cannot hold someone with suspicion until it's verified. They can only hold them the standard 24-48 hours depending on jurisdiction. If they can't charge them with a crime by then, they have to let them go anyway based on 4th amendment freedom of unwarranted search and seizures. One of the 3 provisions they threw out was the ability to hold someone longer until they could verify who they were, which goes against the 4th amendment and obviously was going to be thrown out.

    And let me go ahead and head off the argument that 24-48 hours is enough time to allow someone to verify their citizenship. If they can't produce papers by then they should be arrested? WRONG. One of the founding principles of this country is innocence until proven guilty. THE POLICE (not the illegal) has 24-48 hours to prove they ARE illegal. The illegal can just sit there with his mouth shut and if the police can't prove it in that time, they walk. And you and I both know that you can't prove someone is illegal in 24-48 hours.

    I think that is only in parts of CA. I know LA did that

    Boss, why do you keep trying to pull the teeth that the SC LEFT in the law? ANY LE, anywhere in the country CAN keep you until they verify YOUR identity. WE as American citizens ARE required to carry ID, and produce that ID at ANY LE's request..... So are illegals different? Without being able to ID them, they have no idea if that person is an escaped prisoner, a wanted drug lord, wanted for MURDER in NYC, etc etc...... Today's decision has taken NONE of that away..... While it is true under this asshole's administration, that ICE may, or may not, cooperate with local jails when it comes to picking up prisoners being released towards deportation, Sheriff Joe will just add a few more tents and hold the illegals until the cows come home, or ice picks them up.... NOTHING says jails HAVE to release illegals back to American streets just because ICE refuses to do their job....This IS a VICTORY for Arizona, and a defeat for obama's AG office......

    Yikes Ray ! I'm glad you are not the AG!!! Cops can't keep an American citizen just to verify your ID if you have done nothing wrong! Nope, Americans are not required to carry ID. We are free to be voluntarily without ID. Unless we do things that do require a permit or licenses of some kind (Driving lic., Hunting / fishing license).
    Standing in your front yard or just walking down the sidewalk requires no ID card ....Yet

    Damn zombie everybody hates it when your are right....good thing it doesn't happen very often.
    I think about the time fence jumpers begin to realized that they are not wanted here and get get booked a few times for not having proper id when they get pulled over for that questionable lane change..maybe get impounded..most will find another state to live in.
    After that it going to be about the feds hooking and shipping ALL of those who get tagged on immigration issues instead housing them like they have been doing.

    I know in salt lake city a few years ago you could read through the inmate roster for ADC and about 30% of the spanish surnames had immigration holds and i guess utah isn't on the ice bus route they always seemed to get released when their local cases were taken care of.
