Anyone ever go to the river on thursday with a job as painter at a pretty reputable classic car restoration shop, and get a call monday morning after the river saying that the shop has closed down? :D not real happy right now, and my Spray equip. ,body tools, tool box, pneumatic equipment.....is in a trailer somewhere!
I have spare tools to keep going, but my good tools are not in my possession...I would never pull this crap with a group of good guys that helped me through a real tough time and string paychecks along for a couple weeks, only to close over a weekend! bullshit!
The monday call explained that he was trying to sell machinery that was in the shop to pay us!...by him showing us that he had a "rush closure"!...this tells me that he is full of shit and needs to rat hole money to keep his own head afloat...what are you thoughts, I know I could call Labor board or EDD...but that definitely seems like a bit of a headache, and want to use that as a last draw!
BTW he said he will let me know when I can get my tools! lol
Trying to be civil for the last couple days, but im really starting to not be so civil about my dilemma!

one more thing!...anyone looking for a painter that speaks perfect english and can explain spanish 50% know candys 80%, freehand airbrushing skills 80%, color matching/blending skill 100%, finish 100% bodyworking skills 100%, fiberglass/gelcoat skill, blends as well in F/g 100%
I am officially looking for work, I know...kinda cheesey but effective!

can you try to file theft charges against him for the tools? i have a friend that was kinda in a similar deal , shop owner closed down over the weekend with my buds tools inside, my buddy tried to be civil and get his tools only to be spoken down too. he left and called the police, filed charges of theft agains the shop owner, had his tools back the next day when the owner found out. laws may be different in cali, but they can't keep you from you're possessions.

He can not keep your tools but there is technically no way to force him to give them back. I would call him demand them politly. if that doesn't work have the cops show up with you, they wont do anything as the matter is civil but perhaps just the fact that they show up will scare him. get your tools and get them now before they get sold as well, then give him the beneift of the doubt a resonable amount of time to pay as he said he would. then call the labor board if he does not.

as bad as it is sometimes things happen, If the guy does not have money you will not be getting it. however if he has your tools then you should not allow him to keep them.

labor board doesnt care about anything but being paid correctly. Hound the crap out of him at his house, work , gym, bar, wherever and you might get lucky. Sorry to here about that, hopefully he will give it back to you.

Tell dude to give you your tools or shit's gonna get ugly for him. A man's tools are his livelyhood, his livelyhood directly affects his family, nobody should f*ck with a man's family.

Once you get your tools back, chalk it up to a bad deal, learn from it and move on. You've got skills, there's got to be a market for them, find it and nail it down.

someone owed me 4k i worked for and quit after hearing the guy was a convicted pedophile. i went and picked up my tools, had words with the guy, asked for my month's paycheck and he wouldn't give it to me. i told him it'd cost him wayyyyyy more than the 4k if he didn't pay up, he didn't. on the way outta the shop , i went by the 7k$$$ motor i had built for his 65gto, pontiac with the a six pack on it, opened the carbs up and dropped as many ujoint needle bearings as i could find into it:p that nite his 65gto got left outside accidently and for some strang reason the next day most of the new paint had lifted off of it:D never got but 1k of the money back, but i did hear from the other fella working there that the pontiac motor i had built blew all to hell when they started it:D he was convicted of child molestation a few months after that. climbed into a hottub with his 16yr old daughter's friend and tried to slide a toe into a inappropriate place:mad:

Go the cop route. If that doesn't work get and attorney immediately to send him a letter.

If he owes you wages he won't pay file with the labor board. They just love employers that stiff people for wages owed. His life will become misery and you will likely get your money and your tools if its made known you are going to the labor board.

Don't fock around though he could skip town with all your shit or sell it.

what's more gross is that he didn't do any time:|err he was told to leave the state of texas, which he did, herd he died recently of stomach/colon cancer though, so karma caught up with his ass, literally:D

If in AZ, the labor board can help you for amounts up to $2500 but that is it. I was owed $12k by a local company here in town and the labor board told me to get an attorney.

In terms of money owed, he must pay you within 10 days or you are entitled to 3X the amount owed in damages.

Now for your tools.... If you are the owner of those tools, have zero debts or liabilities with the guy, and he has them without your authority and will not return them, that is theft in my book. Call the police and have them assist you.

If you know where the tools are,Go there and call the cops they will make him give them up or go to Jail.

You can not hold someones personal property or work tools in Cali.
