Default need some help or suggestions on recovering money and or property in Roseburg,Or.

    greeting fellow boaters,
I have been around V-drive boats most of my life, I started handing wrenched into flatbottom boats to my dad at the age of 6, some 47 years ago. I have always trusted people to do the right thing, and I have treated people as I want to be treated.
I have done business with the man in question for 12 years or so.and spent some were around $10,000 in his shop over the years.
In November of last year I was looking to sell a 4 bolt bbc block, because things were tight, and I told this person I would sell to him for $300, So he came and got the block he said he would pay me in 2 or 3 weeks, no problem I said. I also had a set of BBC Vortec heads, new in the GM wraping. he took the heads also and said he sell those also, I told him we had $450 in the heads. The heads were my dad's. my dad bought a complete 540 ci engine from him also.
I saw the heads go on ebay for $550 on Feb 4th.
I have call his number pretty much every week since the 1st of the year, he does not take my calls or return my calls. I have had some health issues and and have not been able to track him. down he live about 1 hour away, I am in Eugene, he is in Roseburg.
This was a buddy's agreement with no paperwork or witnesses, unless you count his 12 year old grandson, who came to help load the block.
racing parts, car truck parts items in ortrailer store on eBay! this is this preson's store were he sold the heads I let him have, and Chevrolet BBC 427 New Forged Crank New Childs Albert Blower Pistons 4 Bolt Main | eBay the block on this sale maybe my block.
So keeping in mind that I do not want to go to jail, how would you guys deal with someone like this? it is not really about the money, for me it's the princible.
I am not a mud slinger, so I have left out this man's name.
Thanks, for any productive idea's in advance.
    Marc

Sorry to hear that. Tough times all over.

Try sending him a registered letter requesting payment or return of the block. Stick to just the facts, date, type of block (serial number etc,) purchase price, agreement to pay within a certain period of time.

If you get no response take him to small claims court. You may never see a dime, but it is worth a try.

What ever you do, don't follow O.J. Simpson lead.

The small claims process is not as simple as some may think but you first have to look into if and where he has his monies that you can recover after receiving a judgment. The court wont collect your money for you, So if he doesn't have a real job or you know his banking information you can vest a lot of time and money just trying to recover your money. I just recently went through a small claims deal for over 5 grand and still haven't collected a dime, but my case was a bit more complicated. Hopefully he will just eventually pay up with out all the hassle of the courts.
